The University of Utah has a definition of sexual assault that includes acts other than intercourse. The University of Utah requires online sexual assault prevention training that includes bystander intervention. The university’s definition of consent does not match EROC’s. They forbid retaliation against survivors but do not provide a definition of what constitutes retaliation.
The Office of Equal Opportunity/Affirmative Action conducts investigations and provides a summary of final findings and conclusions. A Committee of either three or five people makes a finding of responsibility. The Dean of Students determines the disciplinary sanction. Possible sanctions are listed. Both parties may retain an attorney at their own cost, but attorneys are discouraged from participating in the investigative procedures. Appeals can be made to the President by both parties for either the finding of responsibility or the sanction. They do not specify whether sanctions go into effect immediately or hold off until the end of appeals. The University of Utah specifies that investigations will be completed within 60 days. Their policy does not mention whether mediation is discouraged in cases of sexual violence. Although investigators are stated to be trained, they are not described as trauma informed.
They provide accommodations to survivors outside of the adjudication process. The University of Utah offers counseling through the University Counseling Center, though it is not specified whether counselors are specifically trained in working with survivors. University of Utah has a Student Health Center, which offers emergency contraception and STI testing. Emergency on-campus medical resources are not available 24/7. The Sexual Assault Victim Advocacy Office provides advocacy for sexual assault survivors on campus, including accompaniment in seeking services or accommodations. The university also provides information on local rape crisis centers. The University of Utah does not specify whether campus police are trauma informed.
