The University of Montana provides an inclusive definition of sexual assault that encompasses acts other than penetration. The University of Montana requires online sexual assault prevention training that includes bystander intervention. The university also has an affirmative consent policy but their definition of affirmative consent only partially matches EROC’s definition. Retaliation is defined and explicitly forbidden.
An investigation officer conducts investigations through interviews with the complainant and respondent and determines the finding of responsibility. This investigator may make recommendations but cannot impose sanctions. The Dean of Students imposes sanctions, and possible sanctions are listed. The University of Montana does not mention whether attorneys may be present or participate in the process. Respondents can appeal a finding that a policy violation occurred, and complainants may appeal a finding that no policy violation occurred. They also do not state whether sanctions go into effect immediately or hold off until the end of appeals. It is unclear whether investigators are trauma informed, the specified timeline for completing investigations, or whether mediation is forbidden in cases of sexual violence.
The University of Montana provides accommodations to survivors outside of the adjudication process. The University of Montana provides sexual assault counseling through SARC. The Curry Health Center serves students, and they provide STI testing. There does not appear to be a sexual assault crisis center. There is an on-campus advocacy center for sexual assault survivors called the Student Advocacy Resource Center (SARC), but the university does not have information and resources on local rape crisis centers. They state that campus police are trauma informed.
