The University of Kansas offers an in-person sexual assault prevention training that includes bystander intervention. The university does not provide a clear definition of sexual assault. There is an affirmative consent policy, however, their definition of affirmative consent only partially matches EROC’s definition. Retaliation is forbidden and their policy gives some examples of retaliation, but a complete definition of retaliation is not provided.
The University of Kansas states that the Office of Institutional Opportunity and Access will open a complaint when there is sufficient information to demonstrate that the complaint falls within the university’s jurisdiction. The Title IX Coordinator will make a finding of responsibility and the Vice Provost for Student Affairs makes the decision about sanctions. They do not provide a sanctioning code and do not publicize the number of cases and sanctions. Both parties are entitled to have an attorney accompany them in meetings with investigators at their own cost. The appeal may be reviewed by an appropriate administrative officer and/or an appeals panel of the Judicial Board. The University of Kansas does not specify whether sanctions go into effect immediately or hold off until the end of appeals. They also do not state whether investigators are trauma informed. The university specifies a 60-day investigation timeline. Mediation is explicitly unavailable for sexual misconduct or sexual violence.
The University of Kansas provides accommodations outside of the adjudication process. They have a student health center with emergency contraception and a sexual assault center where evidentiary exams can be performed. The University of Kansas also has CARE (Campus Assistance, Resource, and Education), which provides advocacy for sexual assault survivors on campus. The university also provides information and resources on local rape crisis centers. However, they do not specify whether campus police are trauma informed.
