South Dakota State University has sexual assault prevention training that includes bystander intervention, but it is not in-person. They provide a clear definition of sexual assault that includes acts other than intercourse. The university does not have an affirmative consent policy. They forbid retaliation against survivors and provide a definition of what constitutes retaliation.
An Administrative Officer and Title IX Coordinator perform investigations and make findings of responsibility in cases of sexual assault. The decision on responsibility must be unanimous. The Administrative Officer alone makes decisions about sanctions. South Dakota State University’s University President reviews any appeals and sanctions are on hold until the appeals process is completed. The university does not provide a sanctioning code, does not mention whether attorneys are permitted during the investigation and adjudication process, and does not publicize the number of cases and sanctions. They forbid mediation in cases of sexual assault and provide a timeline of 20 days for an investigation. The university does not state whether investigators are trauma informed, only that they have received training.
They state that requests for accommodations outside of the investigation and adjudication process are reviewed on a case-by-case basis and granted, “if they are reasonably available.” South Dakota State University has a student health center where emergency contraception is available. However, the student health center does not have a sexual assault center. They also do not have an on-campus advocacy center for sexual assault survivors. The university provides information on local resources and rape crisis centers, but does not specify whether campus police are trauma informed.
